Frequently Asked Questions
Do I have to file an income tax return if I am living and working overseas? +
Nearly every U.S. citizen and Green Card holder, regardless of where they live, must file a U.S. income tax return each year to report worldwide income. Many states also require filing when living abroad.
What are the IRS amnesty programs for taxpayers with unreported foreign income or assets? +
The IRS offers several amnesty programs, including the offshore voluntary disclosure program, streamlined filing procedures, delinquent FBAR submission procedure, and delinquent international information return submission procedure. These programs allow taxpayers to come into compliance by filing or amending a few years of tax returns and FBARs, often with reduced penalties or no penalties.
What documents are needed to prepare a U.S. income tax return for expats? +
Required documents include Forms W-2, foreign wage statements, all Forms 1099, brokerage statements, Schedule K-1 from partnerships or trusts, statements supporting deductions, a copy of last year's U.S. tax return, a copy of the foreign country tax return (if applicable), a list of travel dates to the U.S. and foreign countries, and maximum values of all foreign bank or financial accounts held during the year.
What is the FBAR filing requirement? +
U.S. persons with foreign financial accounts exceeding $10,000 in aggregate value at any time during the calendar year must file an FBAR electronically through FinCEN's BSA E-Filing System by June 30 of the year following the calendar year being reported. The FBAR is not filed with a federal tax return and has no extension provision.
